Terms of Service
The short version: CardMe suggests which of your cards to use for a purchase. Those suggestions are information, not financial advice — your card issuer's terms are what actually govern your rewards. We never move money and never ask for your card numbers. The full terms are below and they are what legally applies.
1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and CardMe (“CardMe”, “we”, “us”) covering your use of the CardMe mobile app and the services it connects to (together, the “Service”).
By creating an account, or by using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Who may use the Service
- You must be at least 18 years old.
- You must be able to form a binding contract where you live.
- The Service is designed for cards and rewards programs issued in the United States. We do not promise it is accurate or appropriate anywhere else.
- One account per person. Keep the information on your account accurate, and keep your password to yourself. You are responsible for what happens under your account.
3. What CardMe does — and what it is not
CardMe looks at the cards you tell us you hold and suggests which one is likely to earn the most on a given purchase or at a nearby merchant.
Those suggestions are informational only. They are not financial, credit, tax, or legal advice, and we are not your financial adviser, broker, or fiduciary. We are not a bank and we do not issue credit.
Rewards rates, categories, caps, bonuses, and merchant classifications are set by card issuers and payment networks, and they change without telling us. A merchant's category code is assigned by its payment processor and often does not match what the business looks like. So a recommendation can be wrong even when everything is working correctly.
Before you rely on a recommendation for anything that matters, check your card issuer's current terms. Where our information and your issuer's disagree, your issuer is right.
We are not affiliated with, endorsed by, or sponsored by any card issuer, bank, or payment network. Their names and logos belong to them and are used only to identify the cards you hold.
4. The cards you add
The cards in your wallet are the ones you tell us about. We do not verify that you hold them, and we do not ask for or store full card numbers, CVVs, or PINs. If the card list is wrong, the recommendations built on it will be wrong too.
5. Location
If you allow it, CardMe uses your device location to find merchants near you and recommend a card for them. That search runs on your device, using Apple Maps.
When you tell us you used or skipped a suggested card at a nearby merchant, or correct a merchant's category, we store that merchant's name, category, and map coordinates with your account. Because the merchant was near you, those records show where you were at the time.
We also record your location, rounded to about one kilometre, each time you open the app, whether or not you ask for a recommendation, so we can understand where and how CardMe is used. This builds a history of the places you have opened the app.
You can turn location access off at any time in iOS Settings. The rest of the app keeps working; the nearby features do not, and openings are then recorded without a location.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to break someone else's rights;
- access an account that is not yours, or share your account credentials;
- scrape, crawl, bulk-download, reverse engineer, or try to derive our source code, data set, or models;
- interfere with the Service — flooding it with requests, probing for vulnerabilities, or working around rate limits or other restrictions;
- upload malware, or anything that damages the Service or other users;
- resell, sublicense, or commercially redistribute the Service or its output.
7. Your content and our content
You keep ownership of what you put into the Service. You grant us a licence to host, process, and display it for the purpose of running the Service for you, and to keep it secure, comply with the law, and improve the Service as described in the Privacy Policy. That licence ends when you delete the content or your account, except for copies in routine backups and anything we must keep by law.
The Service itself — the app, its design, and our data and content — belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use it under these Terms. Everything not granted is reserved.
8. Third-party services
The Service depends on third parties, including Apple, Google, and our hosting and authentication providers. We are not responsible for their services, and if one of them goes down, degrades, or changes its terms, parts of CardMe may stop working. Your use of those services may be governed by their own terms.
9. Suspending or ending your account
You may stop using the Service and delete your account at any time. Deleting your account removes your data as described in the Privacy Policy.
We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if keeping your account open creates a risk to the Service or to other users. Where it is reasonable to do so, we will tell you first.
We may also discontinue the Service, or any part of it.
10. Changes to these Terms
We may update these Terms. When we make a material change we will raise the version number, post the updated Terms in the app, and ask you to accept them again. Continuing to use the Service after a change means you accept it. If you do not accept, stop using the Service and delete your account.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that recommendations will be accurate or will maximise your rewards, or that card and reward data will be complete or current.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDME AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REWARDS OR POINTS, LOST DATA, OR FOREGONE SAVINGS, ARISING OUT OF OR RELATING TO THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
13. Indemnity
You agree to indemnify and hold CardMe harmless from claims, damages, and reasonable legal fees arising from your misuse of the Service, your breach of these Terms, or your violation of the law or of someone else's rights.
14. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.
15. Disputes
We would rather fix a problem than argue about it — please contact us at support@cardmeapp.com first, and we will try to resolve it informally within 30 days.
If we cannot, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property.
YOU AND CARDME AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
If the arbitration agreement is held unenforceable, the dispute will be heard in the courts located in Santa Clara County, California, and you consent to their jurisdiction.
16. General
If a provision of these Terms is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between us about the Service.
